Guangdong will be severely punished for dumping construction waste without authorization and failing to change within the time limit

Those who dump or sprinkle construction waste without authorization and fail to correct within the time limit may face heavy fines. On July 28, the 45th meeting of the Standing Committee of the 13th Provincial People's Congress deliberated on the regulations of Guangdong Province on the management of construction waste (Draft) (hereinafter referred to as the "draft regulations"). In view of the low level of comprehensive utilization of construction waste in our province and the imperfect joint supervision mechanism of departments, Guangdong plans to legislate to clarify the contents of construction waste transportation, waste disposal site management, cross regional balanced disposal, etc., so as to provide legal guarantee for the construction of "waste free city".

Construction waste transportation management is an important part of urban pollution prevention and control. The draft regulation stipulates that during the transportation of construction waste, the means of transportation should be kept clean, sealed or other effective measures should be taken to prevent spillage, construction waste should not be dumped or scattered without authorization, and it should be transported according to the route and place determined by the treatment plan. Violators shall be ordered by the competent environmental health department of the government at or above the county level to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be fined not less than 10000 yuan but not more than 100000 yuan.

In addition, the Provincial Department of housing and urban rural development pointed out in its explanation of the draft regulations that, drawing on the lessons of the previous major landslide accident, it plans to clarify the supervision and management responsibilities of the competent environmental health departments of the government at or above the county level for the consumption site, authorize the competent environmental health departments of the provincial government to prepare construction standards and operation specifications, and stipulate the safety management responsibilities of enterprises and governments after the construction, operation and cessation of consumption of the consumption site. In terms of standardizing the operation of waste disposal sites, it is proposed to stipulate that construction waste disposal sites should establish standardized and complete production accounts. If they violate the management of accounts and fail to correct within the time limit, they will be fined not less than 10000 yuan but not more than 100000 yuan.

Under the requirements of urban sustainable development, how to "turn waste into treasure" of construction waste is widely concerned. The draft regulation stipulates that in government procurement, priority should be given to the procurement of construction waste comprehensive utilization products that meet the technical standards and meet the use functions, and the use of social capital investment projects should be encouraged.

The cross regional illegal behavior of construction waste has always been the difficulty of law enforcement. In this regard, the draft regulations propose that governments at or above the county level should establish and improve the cross regional law enforcement cooperation mechanism, and carry out joint law enforcement against illegal acts such as dumping, scattering or stacking construction waste without authorization across regions. In addition, it is forbidden to engage in activities that damage the ecosystem and pollute the environment, such as washing or soaking construction waste, in sea waterways and river waters, as well as other places specified by the state and the province, so as to deepen the battle for pollution prevention and control.
